Child support is one of the most highly contested issues in a divorce and there are many factors which may impact the amount of child support to be awarded in each case. Child Support Standards Act

New York follows what is commonly referred to as the Child Support Standards Act to determine the amount that must be paid using a statutory formula. 

 

Although New York Courts follow a statutory factor, there are many variables that may have an impact on the calculations made by applying the statutory formula as well as factors that can be considered to deviate upwards or downwards from the formula.

Parents will be expected to make their payments, and if they cannot, the child support order may be enforced through automatic paycheck deductions and other methods up to potential jail time.
