Custody

Custody Defined

New York law breaks the issue of custody into two separate categories: (1) legal custody (decision making) and (2) residential custody. Custody determinations are based on what is in the best interests of the child.

Custody Disputes

New York Courts make determinations on custody based on what will serve the best interests of the child or children in issue. There are many factors that are weighed in reaching this decision, including the quality of the home environment and the parental guidance the parent provides for the child, the ability to financially provide for a child,  and the ability of each parent to provide for the child's emotional and intellectual development. Even when custody is not in dispute, these factors may play a role in the non-custodial parent's parenting time with the child.
