New York No Fault Law

Prior to August 15, 2010, New York divorces could only be accomplished through fault-based grounds, which, if contested, would have to be proven to the Court in order to proceed to a divorce. On August 15, 2010, New York State enacted no-fault, allowing a spouse to proceed with a divorce without having to prove fault to the Court, provided that the marriage is six months or more, and only one spouse states that there has been an irretrievable breakdown in communications for at least six months. Now, if one spouse seeks a divorce, that spouse may proceed with the divorce without proving fault. However, the divorce will be finalized after all other issues such as child custody, child support, spousal maintenance, and division of marital property are resolved.
